Summer is one of the most popular seasons for visiting Canada. Whether you're planning to tour, attend events, or visit family, it's essential to understand Canadian border entry laws.

🔹 What is Inadmissibility?

Only Canadian citizens have a guaranteed right of entry. Foreign nationals—especially those with a criminal record—may be denied entry even as tourists. Canada strictly screens travelers to protect national security.

🔹 Which Offenses Can Make You Inadmissible?

If your past offense is considered a crime both in Canada and the country it was committed in, you could be inadmissible. There are two main categories:

1. Criminality

You may be inadmissible if:

  • You were convicted of a crime abroad equivalent to an Indictable Offense in Canada.

  • You committed two summary offenses considered crimes under Canadian law.

  • You committed any act that is a crime in both jurisdictions.

📝 Indictable = serious crimes (like felonies), Summary = minor offenses (like infractions).

2. Serious Criminality

You’re inadmissible if:

  • You were convicted in Canada for a crime punishable by 10+ years OR served more than 6 months in jail.

  • You were convicted abroad for a crime that would carry a 10+ year sentence in Canada.

✖ Minor violations like parking tickets won’t cause inadmissibility, but DUI (driving under influence) will.


🔹 What Can You Do If You Are Inadmissible?

1. Apply for a Temporary Resident Permit (TRP)

  • Best for urgent visits (e.g., wedding, family emergency, work).

  • Must show valid reason + full documentation.

  • Takes 3–6 months to process.

  • U.S. citizens/Green Card holders can apply at the border (not guaranteed).

2. Deemed Rehabilitation

  • For 1 indictable offense: after 10 years

  • For summary offenses: after 5 years

  • Time counted from sentence completion, not conviction date.

  • Legal Opinion Letter from a lawyer is highly recommended.

⚠ Not available for serious criminality.

3. Criminal Rehabilitation

  • For those ineligible for deemed rehab.

  • You must wait 5+ years after completing all sentence terms.

  • Once approved, you’re no longer inadmissible for that offense.

  • Long processing time, but can apply for TRP meanwhile.
